Legal

My partner has officially been granted a VISA by the UK today. Only took 10 fucking years, immigration lawyers etc.

We can finally have a joint bank account and travel outside the borders of the UK together, for purposes such as introducing our son to our respective grandparents, aunts and uncles.

My partner is Brazilian. I had the fortune that my previous place of employ had tons of immigration issues, so I got a recommendation through there. Later on, I found a UK immigration forum that featured some internal poll where this lawyer actually turned up trumps. If anyone needs a good immigrations lawyer, please PM me - I really think highly of this guy.

If I had timed everything perfectly, which is to say that I had engaged with the lawyer and subsequently the home office after having lived together with my partner for exactly 1.5 years, the whole thing would have cost me about 1500 GBP all in. Because I approached the lawyer early into our relationship, I paid a little extra. Technically, you do not need a solicitor at all for this application. The stories I have heard from people that have tried that route led me to believe that I shouldn't even try.

This could have gone another way though: had the home office actually rejected the claim, then I would have had to hire a barrister for an appeals (or again, technically, do it myself lerskates). Then your're looking at hourly rates over weeks, which can easily run you into the 10's of thousands.

The crazy thing is that due to our son, who is German and Brazilian and therefore crucially an EU citizen as well, she qualifies for an automatic EU visa anyway as per EU immigration law. I know that this would have happened in Germany, for example - had some discussions with the Germany embassy to see if they could have helped in any sense, but unfortunately that was a no-go. The home office in the UK has apparently not yet figured out 'how to implement' this particular law. Therefore; another route I could've taken is to take the UK to the EU court of law. This would have been the moral and upstanding thing to do, but apparently that court has a huge backlog and I dare not think what such a process would have cost me... I was advised against it by my solicitor.

So yeah, the whole experience over the past 3 years has been pretty eye-opening. Combine that with shit like the police stopping my girlfriend while switching tubes at Baker Street and asking for immigration papers a few months back, etc. Good times that are now forever behind us. Big relief.

That's great news and a weight off both of your minds I'm sure

I'm now (as of today) officially dual nationality but the only benefit I for me is that I can now vote here. Had to pay 440€ for the benefit.

And immigration checks at Baker Street? Wtf? Were they stopping people who looked foreign or summat?

There's another, more subtle thing that she is pursuing. She wants to put more stringent immigration controls on 'criminals'. On paper, that sounds like something that would be hard to argue with - who wants more arms dealers or bank robbers in their country, right?

In practice, there is a lot of devil in the detail. If you are on a legitimate VISA with an expiry date, say, in 3 months time, it is perfectly legal for you to apply for some VISA extension or another VISA that you think might be applicable to you. While you have an application with the home office, no matter if you still have a valid VISA or not, you are permitted to stay in the country.

The home office cannot take longer than 6 months to process VISAs. But, at the end of their 6 month processing period, they can come back to you and tell you that they 'lost' all of your paperwork. This actually happens - I know of 3 cases just in my partner's circle of friends. Congratulations, in the eyes of the UK you are now a criminal, and your second request can be declined on the grounds of you being criminal. This, in a nutshell, is why you should hire a lawyer.
